A.J. Buttacavoli, Apostles of Christ, Oakland, complained that emergency vehicles use sirens when it is not necessary;
Mabe Muanza said she feels the County's Foster Care Program and placement need to be investigated and corrected;
Sally Morgan Welch. Martinez resident, spoke about proper animal care and the problem of animal cruelty; and
Jerry Shoaff, Danville resident, spoke regarding Contra Costa Council's Social Responsibility Task Force and provided supporting materials.

Chair Bonilla requested that the response to Recommendation No. 3 be expanded to explain the current and probable future funding issues behind the County’s position, and that information on the possibility of mental health stimulus funds being used to restore the Mental Health Specialist position noted in Recommendation No. 4 also be included.

HEARING on an appeal of a decision by the County Planning Commission to deny a variance request for a reduced side yard for a 19 foot tall deck, at 4202 Foster Lane in the El Sobrante area.   Aruna Bhat, Department of Conservation and Development, presented the staff report.

Chair Bonilla opened the public hearing. The following spoke in favor of granting of the variance:

John and Jerilyn Hornyak, applicants; Nancy Samuel, neighbor; Lisa Sias, neighbor.

Chair Bonilla closed the hearing.

Supervisor Gioia said he had visited the property and recognizes that there is unique topography in the area and that many homes have a deck. He noted that the El Sobrante Valley Zoning and Planning Advisory Committee had no objections to granting the variance if the building code requirements were met. He further noted that the aplication for variance and the permitting process are separate functions.

Persons who wish to speak on matters set for PUBLIC HEARINGS will be heard when the Chair calls for comments from those persons who are in support thereof or in opposition thereto.
