        D. 2   PUBLIC COMMENT (2 Minutes/Speaker)
  Eli Dominguez, resident of Martinez, spoke of unsatisfactory care and treatment he received from Contra Costa Regional Medical Center;

Allyn Lee, resident of Alamo, longtime volunteer for children’s and animal welfare programs and current volunteer at the Animal Services Department, expressed her interest in the appointment of a new director for Animal Services, and encouraged the Board to choose a flexible and skilled leader;

Marty Tatti, resident of Walnut Creek, 7 year volunteer at Animal Services, expressed the need for a future department director willing to examine reforms and be open to input and consideration from employee and volunteers. Ms. Tatti noted that at this time personnel did not feel comfortable speaking out regarding changes;

Stan Berrigan spoke on an unacceptable level of crimes committed on Ellis Street in Concord;
         The Chair advised Mr. Berrigan to bring his concerns to the City Council of Concord, as the Board has no jurisdiction in incorporated cities;

Gigi Crowder, resident of Antioch, expressed pleasure at the Board’s recognition of Red Ribbon Day and support for those with substance abuse issues and requested that people of color be remembered in the County’s programs;

Ralph Hoffmann, resident of Walnut Creek, addressed the Board on his dismay at the Republican Party denial of climate change science and the need for a larger public transit system (handout attached);

Eileen Bissen, Public Employee’s Union Local, spoke on the order of items scheduled on the Board’s agenda in regard to the inconvenience posed to employees who took time off to speak to the Board and disagreement with the placement of controversial items later in the day;

Peter Mantos, commented on October 7, 2014, regarding what is consistent in that meeting as with those in the past. He noted that many issues were controversial and programs were ultimately implemented with the Board working diligently with staff and the community. Mr. Mantos requests the Board continue that leadership in mental health programs;

Connie Steers, spoke about the earlier speaker’s difficulties in obtaining service at CCRMC. Ms. Steers would like to see a process to handle these problems until such time as the County once again has patients’ rights advocates contracts implemented and those personnel trained;

Teresa Pasquini, resident of El Sobrante, spoke on her advocacy for mental health patients, and how failure to assist mental health consumers early on will result in those consumers becoming candidates for Laura’s Law level intervention in the future.

  D. 8    HEARING to consider amending the North Gate Specific Plan and approving a development plan/land use permit to allow limited winemaking/winery operations at Shadowbrook Winery in the unincorporated North Gate area of Walnut Creek, to consider an appeal of the County Planning Commission’s decision to limit the height of a proposed winery building to 20 feet rather than 28 feet at Shadowbrook Winery, and to consider related California Environmental Quality Act actions, as recommended by the Conservation and Development Interim Director. (John Oborne and Pat Roche, Conservation and Development Department)

CLOSED the public hearing;

ADOPTED the amendment to the North Gate Specific Plan as the fourth amendment to said Specific Plan, to allow limited winemaking/winery operation on a parcel zoned for agricultural use, or on a single-family zoned parcel of not less than 1-acre, if limited to no more than 3,000 cases of wine per year produced on the premises with tastings and tours by appointment only, a maximum of 12 wine marketing events per year, and incidental retail sales as part of the tastings, tours and events;

FOUND that the proposed amendment to the North Gate Specific Plan is consistent with the overall goals and objectives of the Contra Costa County General Plan (2005-2020) and the North Gate Specific Plan;

GRANTED the appeal of the applicant to allow a 28 foot height on the proposed winery building on the project site, located at 900 North Gate Road based on the following finding : that the modification is consistent with the intent and purpose of the P-1 district and compatible with other uses in the vicinity, both inside and outside the district;

GRANTED the appeal of the applicant and REJECTED the County Planning Commission's (CPC) decision to limit the height of a proposed winery building to 20 feet rather than 28 feet on the project site, located at 900 North Gate Road, as proposed under their Land Use permit/Development Plan and Specific Plan Amendment application;

FOUND that on the basis of the whole record, including the Initial Study/Mitigated Negative Declaration (IS/MND) prepared for this project, that there is no substantial evidence that the project will have significant effect on the environment and that the IS/MND was prepared in accordance with the California Environmental Quality Act (CEQA) and it reflects the County's independent judgment and analysis.

ACCEPTED the recommendation of the County Planning Commission as contained in their Resolution No. 5-2014, with the exception of the recommendation to limit the building height to 20 feet;

ACCEPTED the recommendation of the Walnut Creek City Council as contained in their Resolution No. 14-54;

ADOPTED Board Resolution No. 2014/152, as amended today to allow for a winery building height of 28 feet, as the basis for the Board's decision;

DIRECTED staff to post a CEQA Notice of Determination for the Mitigated Negative Declaration for this project with the County Clerk
.

All matters listed under CONSENT ITEMS are considered by the Board to be routine and will be enacted by one motion. There will be no separate discussion of these items unless requested by a member of the Board or a member of the public prior to the time the Board votes on the motion to adopt. 

Persons who wish to speak on matters set for PUBLIC HEARINGS will be heard when the Chair calls for comments from those persons who are in support thereof or in opposition thereto.
