RECOMMENDATION(S):

AUTHORIZE the Chair of the Board of Directors, or the Fire Chief or designee, to execute grant deeds formalizing Contra Costa County Fire Protection District's (CCCFPD) ownership of eight properties formerly owned by the East Contra Costa Fire Protection District (ECCFPD) in Brentwood, Oakley, Discovery Bay, and Knightsen; and  
  

AUTHORIZE the Fire Chief, or designee, to take any and all actions necessary to complete acceptance of the properties and to accept any quitclaim deeds or other release of interest granted by a previous owner of any of the subject properties. (No fiscal impact)

FISCAL IMPACT:

No fiscal impact. The purpose of this action is to enable a record of the transfer of real properties to be recorded with the County Clerk Recorder's office.


BACKGROUND:

Dissolution of East Contra Costa County Fire Protection District  
  
On September 14, 2021, this Board adopted Resolution No. 2021/8, authorizing the Fire Chief, or designee, to submit an application to the Contra Costa Local Agency Formation Commission (LAFCO) requesting that LAFCO initiate proceedings for the dissolution of the East Contra Costa Fire Protection District (ECCFPD) and the annexation of ECCFPD’s service area into the Contra Costa County Fire Protection District (District).  
  
On March 9, 2022, LAFCO adopted Resolution No. 21-11, approving the dissolution of ECCFPD and the annexation of ECCFPD’s service area into the District. The adoption triggered a protest period, during which voters could petition to place ECCFPD’s dissolution on the ballot for a future election. The protest period ended April 11, 2022. No protests were filed. On April 13, 2022, LAFCO ordered the dissolution of ECCFPD without confirmation of the voters.  
  
On May 25, 2022, LAFCO recorded its certificate of completion with the County Recorder and filed a copy of the certificate with the Board of Equalization. With these actions, ECCFPD has been formally dissolved and annexed into the District in accordance with the terms of LAFCO Resolution No. 21-11.  
  
In accordance with the terms of LAFCO Resolution No. 21-11, upon the dissolution of ECCFPD, all of the assets of ECCFPD were transferred to the District as the successor to ECCFPD.  
  
  
Real Property  
  
As a result of the actions taken by LAFCO, the District is now the owner of the following real property:  
  
1. 201 John Muir Parkway, Brentwood, APN 019-340-039  
2. 739 First Street, Brentwood, APN 013-091-017  
3. A 5.4-acre vacant lot located at Empire Avenue and Grant Street in Brentwood, APN 019-020-045  
4. 530 Ohara Avenue, Oakley, APN 035-300-013 & 035-300-019  
5. 3200 East Cypress Road, Oakley, APN 032-370-012  
6. A 1.07-acre vacant lot located at Live Oak Avenue and Neroy Road in Oakley, APN 041-021-014  
7. 1685 Bixler Road, Discovery Bay, APN 011-230-033  
8. 15 A Street, Knightsen, APN 020-072-001  
  
To ensure that the District’s ownership of the properties is reflected in the chain of title, a grant deed for each property will be recorded in the County’s official records.

CONSEQUENCE OF NEGATIVE ACTION:

If this action is not approved, Contra County Fire Protection District's ownership of the former East Contra Costa Fire Protection District property will not be reflected in the chain of title.
