DIRECT the Director of the Department of Conservation and Development (DCD) to file a Notice of Exemption with the County Clerk and DIRECT the Public Works Director to arrange for payment of a $50.00 handling fee to the County Clerk for filing, and a $25.00 fee to DCD for processing of the Notice of Exemption.
DETERMINE said property to be surplus and no longer necessary for county or other public purposes, and its estimated value does not exceed twenty-five thousand dollars ($25,000).
AUTHORIZE the Chair, Board of Supervisors, to execute a Grant Deed on behalf of the County.
DIRECT the Real Estate Division of the Public Works Department to cause said Grant Deed and a certified copy of the board order to be delivered to the grantee for recording in the office of the County Clerk-Recorder.
FISCAL IMPACT:
100% Applicant Fees.
BACKGROUND:
On June 24, 1954, Contra Costa County (County) accepted a deed adjacent to a portion of Haag Road and identified as Assessor’s Parcel Number 162-251-014 in Martinez, for a public street or highway purposes.
County staff has determined that the western portion of this property has been conveyed for the purposes identified above and the remaining portion is excess right-of-way no longer needed for public or county purposes. The adjacent property owner has requested the County convey this excess area in order to maintain and landscape it.
CONSEQUENCE OF NEGATIVE ACTION:
The County would continue to own and be liable for the maintenance of property that is no longer needed for County purposes.
