The Board clarified that the proposed ordinance would apply only to new construction projects, not including any restaurant or industrial buildings.  In the proposed draft ordinance to be brought back to the Board for review, staff will address concerns related to:

1. Accessory Dwelling Units (ADU's), specifically in regard to attached/detached, with the expectation that attached units would be allowed to continue the energy delivery model of the dwelling it would be attached to (detached would qualify as a new building);
2. The allowed use of backup power sources such as generators that may be fossil-fuel operated that would be used as replacement power should there be an emergency in which electric power is not available;
3. The possible need for exemptions in locations where the supply of solar and/or electric power is not reliable or deemed sufficient;
4. The timing of when the draft ordinance provisions would come into effect in relation to the new construction, such as the date upon which the application for a building permit is filed;

ADOPTED the staff recommendations to include those matters raised today and REQUESTED that staff provide information to the Board in regard to future retrofit of existing buildings, particularly those located in low-income area's.

   Lisa Kirk thanked Supervisor Mitchoff for her assistance in raising awareness of the needs for funds for the Animal Benefit Fund. She inquired as to why the fund was not mentioned the discussion of American Recovery Act funding (item D.4).  She also noted a concern with the Bradford Island fire, from which East Contra Costa Fire is standing down from, the area being outside their jurisdiction. She said 9 homes have been lost and seeks inquiry from Board members on the status of fire suppression on the island;  written commentary attached.

Edith Pastrano, in support of the tenants at 1366 Oakland Blvd, Walnut Creek. who received eviction notices yesterday;

David Sharples, Richmond Alliance of Californians for Community Empowerment (ACCE), in support of the tenants of 1366 Oakland Blvd, Walnut Creek who received eviction notices. The new owner of the multi-unit building distributed notices stating the owner intended to signficantly remodel the premises, and the owner refused to accept rent payments based on this intent, a violation of the county's eviction moratorium.

The Board meets in all its capacities pursuant to Ordinance Code Section 24-2.402, including as the Housing Authority and the Successor Agency to the Redevelopment Agency. Persons who wish to address the Board should complete the form provided for that purpose and furnish a copy of any written statement to the Clerk.

Any disclosable public records related to an open session item on a regular meeting agenda and distributed by the Clerk of the Board to a majority of the members of the Board of Supervisors less than 96 hours prior to that meeting are available for public inspection at 1025 Escobar Street, First Floor, Martinez, CA 94553, during normal business hours.

All matters listed under CONSENT ITEMS are considered by the Board to be routine and will be enacted by one motion. There will be no separate discussion of these items unless requested by a member of the Board or a member of the public prior to the time the Board votes on the motion to adopt. 

Persons who wish to speak on matters set for PUBLIC HEARINGS will be heard when the Chair calls for comments from those persons who are in support thereof or in opposition thereto. After persons have spoken, the hearing is closed and the matter is subject to discussion and action by the Board.  Comments on matters listed on the agenda or otherwise within the purview of the Board of Supervisors can be submitted to the office of the Clerk of the Board via mail: Board of Supervisors, 1025 Escobar Street, First Floor, Martinez, CA 94553
