RECOMMENDATION(S):

APPROVE Appropriation and Revenue Adjustment No.5094 authorizing new revenue in the amount of $241,385 in the District Attorney's Office (0242) and appropriating it to the District Attorney of the County of New York (DANY) Sexual Assault Kit Backlog Elimination Program and Organized Auto Insurance Fraud Program.

FISCAL IMPACT:

This action increases revenue by $ 241,385 for FY 17/18. To offset the funding in BU 0242.

BACKGROUND:

The District Attorney of the County of New York (DANY) Sexual Assault Kit Backlog Elimination Program began providing funds allowing the Contra Costa County District Attorney's Office to work collaboratively with local law enforcement, the Contra Costa County Office of the Sheriff Forensic Services Division, and private testing labs to test the backlog of sexual assault evidence kits. The DNA evidence from the kits is used to help solve sexual assault cases.

The Organized Automobile fraud Activity Interdiction Program award is allocated from funds received per Insurance Code 1874.8, whereby each insurer doing business in California pays an annual fee of $ .50 for each vehicle insured under an insurance policy it issues in this state. A portion of the assessment amount is earmarked for distribution to District Attorneys for enhanced investigation and prosecution of organized automobile insurance fraud.  

CONSEQUENCE OF NEGATIVE ACTION:

Appropriation and revenue adjustment for these grants will not be properly reflected in the FY 2017/18 budget.
