RECOMMENDATION(S):

Approve and authorize the Auditor-Controller, or designee, to pay an amount not to exceed $60,000 to Per Diem Staffing Systems, Inc. for respiratory therapists, nursing and other medical staffing services rendered to Contra Costa Regional Medical Center and Health Centers (CCRMC), for the period June 1, 2017 through June 30, 2017.

FISCAL IMPACT:

This contract is funded 100% Hospital Enterprise Fund I. (No rate increase)













BACKGROUND:

On June 7, 2016 the Board of Supervisors approved Contract #26-306-26 with Per Diem Staffing Systems, Inc., for the provision of respiratory therapists, nursing and other medical staffing services for the period from July 1, 2016 through June 30, 2017. At the time of negotiations, the payment limit was based on target levels of utilization. However, the utilization during the term of the agreement was higher than originally anticipated. The Contractor is entitled to payment for the reasonable value of its services under the equitable relief theory of quantum meruit. That theory provides that where a contractor has been asked to provide services without a valid contract, and the contractor does so to the benefit of the County, the Contractor is entitled to recover the reasonable value of those services. Per Diem Staffing Systems, Inc. provided services at the request of the County after the original contract payment limit had been reached.  
  
The Department is requesting the amount due the Contractor be paid in an amount not to exceed $60,000 for services rendered from June 1, 2017 through June 30, 2017.

CONSEQUENCE OF NEGATIVE ACTION:

If this payment is not approved through June 30, 2017, the Contractor will not be paid for services provided in good faith.
