RECOMMENDATION(S):

AUTHORIZE the Public Works Director, or designee, to execute an option agreement and all ancillary documents necessary to implement the sale of the former Pinole Animal Shelter, located at 910 San Pablo Avenue in Pinole, to Fix Our Ferals, a non-profit organization, for $42,000.  
  

AUTHORIZE the Chair, Board of Supervisors, to execute on behalf of the County a grant deed conveying the property to Fix Our Ferals, with reversionary language that requires the property to be used for the purpose of providing services to animals and the community through the sheltering, adoption, and provision of free or low-cost medical treatments to animals, and the administration of such uses for a minimum of 25 years.  





RECOMMENDATION(S): (CONT'D)
  
DETERMINE that the activity is not subject to the California Environmental Quality Act (CEQA), pursuant to Article 5, Section 15061(b)(3) of the CEQA guidelines.  
  
DIRECT the Director of the Conservation and Development Department (DCD) to file a Notice of Exemption with the County Clerk.  
  
AUTHORIZE the Public Works Director, or designees, to arrange for payment of a $50 fee to the County Clerk for filing, and a $25 fee to DCD for processing the Notice of Exemption.  
  
DIRECT the Real Estate Division of the Public Works Department to cause the grant deed to be recorded on behalf of Fix Our Ferals in the office of the Clerk-Recorder.

FISCAL IMPACT:

The property is being transferred to Fix our Ferals, dba Animal Fix Clinic, for $42,000, 100% General Fund.

BACKGROUND:

On July 8, 2002 the Board of Supervisors (Board) adopted a Resolution to authorize the exchange of County Real Property with the Pinole Redevelopment Agency for the West County Animal Shelter Facility located at 910 San Pablo Avenue in Pinole. The shelter building was underutilized because it does not have an outdoor exercise area and was built without surgical facilities for small animals. In August, 2020, the Board directed the County Administrator's Office to take steps to permanently close the Pinole Animal Shelter. Animal Services stopped offering adoption services at the shelter in October 2020 . In August, 2021, the Board declared the property to be surplus and not needed for County or other public purposes.   
  
To further the mission of the Animal Services Department and fill a gap in animal services in the Pinole area, a request for proposals was sent to 501c3 animal welfare organizations to bid on the property. The organization that was chosen, Fix Our Ferals, will provide low-cost spay/neuter services and veterinary medicine to the community.

CONSEQUENCE OF NEGATIVE ACTION:

The County would continue to own and be liable for the maintenance of property that is not needed for County or public purposes.
