RECOMMENDATION(S):

APPROVE and AUTHORIZE the Conservation and Development Director, or designee, to execute a contract amendment with Placeworks, Inc., to increase the payment limit by 266,453 from $3,722,333 to $3,988,786, with no change to the term August 15, 2018 through December 31, 2024, and revise the scope of work to include consulting services related to environmental review of the General Plan Housing Element and support for the Measure X Housing Trust Fund.

FISCAL IMPACT:

In August 2018, the Board authorized a contract with Placeworks for General Plan 2040, Zoning Code Update, and Climate Action Plan (CAP) for a total payment limit of $3,190,376. In November 2021, this was amended to add additional consulting work to write the Housing Element, write Objective Design Standards, and conduct more CAP outreach. The proposed second amendment would increase the total payment limit by $266,453 to $3,988,786 for additional work related to the Housing Element environmental review, not originally scoped at the same level, additional technical work on Housing Element requirements that are new from the State since the contract was scoped, and facilitation, research, and other support for the Measure X Housing Trust Fund.

The additional work will be funded from the Land Development Fund (ORG #2601).

BACKGROUND:

The Envision Contra Costa 2040 project started in December 2017 under Board direction. In August 2018, the Board authorized a contract with Placeworks for General Plan 2040, Zoning Code Update, and Climate Action Plan (CAP) for a total payment limit of $3,190,376. In November 2021, this was amended to add additional consulting work to write the Housing Element, write Objective Design Standards, and conduct more CAP outreach. Since that time, the necessary work to complete the Housing Element has increased to comprise a planned Environmental Impact Report (EIR) rather than the lesser-level environmental review originally contemplated, because the environmental work for Envision Contra Costa 2040 is not yet complete and can't be used for the Housing Element, which has a mandatory completion date of January 2023. Placeworks is also recommending additional work be done in the area of fair housing analysis, based on what their staff has seen in the State's comments on other jurisdictions' housing elements, not known at the time of contract approval. Finally, since Measure X funding allocations were approved by the Board in November 2021, an interdepartmental staff group has been meeting regularly to develop an outreach plan and funding

framework, with need for consultant support for facilitation and information gathering. Altogether, these items total an additional $266,453 of work and DCD recommends approving a second contract amendment to cover them. This would bring the total contract value to $3,988,786.
