RECOMMENDATION(S):

APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County Contract #23-710-2 with Fulgent Therapeutics LLC, a limited liability company, including mutual indemnification, in an amount not to exceed $350,000, to provide COVID-19 clinical laboratory services for Contra Costa Health Services (CCHS), for the period from July 1, 2022 through June 30, 2023.

FISCAL IMPACT:

Approval of this contract will result in annual expenditure of up to $350,000 for FY 2022-2023 and will be funded 100% by American Rescue Plan Act allocations.

BACKGROUND:

This contract establishes a relationship between CCHS and the contractor to increase the County's ability to processes laboratory specimens related to COVID-19 testing collected throughout the County and reduce delays in receiving test results. Fulgent Therapeutics LLC is an independent laboratory that has the facilities and expertise to provide COVID-19 testing to physicians, hospitals, laboratories and other entities including employers qualified to purchase and provide COVID-19 testing services to individuals. This contractor has been providing services since March 15, 2021.

On March 23, 2021, the Board of Supervisors approved Contract #23-710 with Fulgent Therapeutics LLC, in an amount of $350,000, to provide COVID-19 clinical laboratory services, for the period from March 15, 2021 through June 14, 2021.

On June 8, 2021, the Board of Supervisors approved Extension Agreement #23-710-1 with Fulgent Therapeutics LLC to extend the termination date from June 14, 2021 through June 30, 2022 with no change in the payment limit, to continue to provide COVID-19 clinical laboratory services.

Approval of Contract #23-710-2 will allow this contractor to continue to provide clinical laboratory services for CCHS through June 30, 2023. This contract includes mutual indemnification to hold harmless both parties for any claims arising out of the performance of this contract.

CONSEQUENCE OF NEGATIVE ACTION:

If this contract is not approved, the County will not have continued access to this contractor’s clinical laboratory services and COVID-19 testing results may be delayed.
