RECOMMENDATION(S):

APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County Novation Contract #28–705–20 containing mutual indemnification with the City of Hercules, a government agency, to pay County in an amount not to exceed $15,000, to provide congregate meal services for County’s Senior Nutrition Program, for the period from July 1, 2022 through June 30, 2023, which includes a three-month automatic extension through September 30, 2023.

FISCAL IMPACT:

The City of Hercules will pay the County the voluntary contributions it receives from participating seniors, after it has paid its authorized expenses. Total payments during the term of the contract are not expected to exceed $15,000. No County match of funds is required.

BACKGROUND:

This contract meets the social needs of the County’s population by providing an average of 35 congregate meals per day, five days per week for senior citizens at the Hercules Senior Center. The County has been contracting with the City of Hercules since October 1, 2002.

On June 8, 2021, the Board of Supervisors approved Novation Contract #28-705-19 with the City of Hercules for the provision of congregate meal services for County’s Senior Nutrition Program, for the period from July 1, 2021 through June 30, 2022, which included a three-month automatic extension through September 30, 2022.

Approval of Novation Contract #28–705–20 replaces the automatic extension under the prior contract and allows the City of Hercules to pay the County a portion of the voluntary contributions from seniors, while they continue providing services through June 30, 2023. This contract includes mutual indemnification.

CONSEQUENCE OF NEGATIVE ACTION:

If this contract is not approved, senior citizens who depend on the County’s Senior Nutrition Program will not receive meals at this contractor’s facility.
