RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute an amendment to the Purchase and Sale Agreement with Davidon Homes effective February 1, 2022, to add a payment limit of $25,000, for demolition of a Pacific Gas and Electric Company (PG&E) vault at 1750 Oak Park Blvd., Pleasant Hill area. Project No.: WH113B.

FISCAL IMPACT:

Expenses incurred in connection with the sale of the property were funded by the County General Fund and were reimbursed through proceeds from the sale.

BACKGROUND:

The terms of the Purchase and Sales Agreement (PSA) dated July 17, 2020, between the County and Davidon Homes (Buyer) for the sale of the real property located at 1750 Oak Park Boulevard in Pleasant Hill required the County to remove all structures and improvements shown on the site plan at the County’s expense. Due to no fault of the County, the County was not able to remove a concrete PG&E vault and connected concrete building footings (Vault). In order to expedite the removal of the Vault and facilitate the Buyer’s ability to construct residential housing on the property, the Buyer removed the Vault.  
  
The purpose of the amendment to the PSA is to enable the County to reimburse the Buyer for the cost of the demolition that was originally to be performed by the County at County expense.  
  
On March 10, 2020, the Board of Supervisors approved the sale of the land and made related CEQA findings.

CONSEQUENCE OF NEGATIVE ACTION:

Without Board approval, Davidon Homes cannot be reimbursed for services provided on behalf of the County.
