RECOMMENDATION(S):

APPROVE and AUTHORIZE fiscal year 2021/22 Appropriations and Revenue Adjustment No.005077, authorizing new revenue in the amount of $971,871 and appropriating it for costs related to transition of the former Los Medanos Community Healthcare District to the County.

FISCAL IMPACT:

Approval of this action will establish revenues and appropriations of $971,871 in Special Revenue Fund 113800, Department 0480 (Los Medanos Community Healthcare District). There is no fiscal impact to the County General Fund. (100% Los Medanos Community Healthcare District)

BACKGROUND:

On September 12, 2018, the Contra Costa Local Agency Formation Commission (LAFCo) adopted Resolution No. 17-13B, approving the dissolution of the Los Medanos Community Healthcare District and appointing Contra Costa County as sucessory agency to the District once the dissolution became effective.

On March 9, 2022, the Local Agency Formation Commission (LAFCo) recorded a Certificate of Completion (Document No. 2022-0042380) with the County Clerk-Recorder dissolving the Los Medanos Community Healthcare District. The recording was completed following action by the California Supreme Court, which denied the Los Medanos Community Healthcare District’s challenging of the dissolution approved by LAFCo and petition requesting review of the Court of Appeal’s decision in Los Medanos Community Healthcare District v. Contra Costa LAFCO and Contra Costa County.  
  
The terms and conditions of the dissolution, among other things, appoint Contra Costa County to serve as successor agency of the dissolved District and charges the County with winding up the former District's affairs. This includes taking possession and disposing of District assets and liabilities. Since the March 9, 2022 dissolution of the District by LAFCo, the County has been working with entities to gain control of the District's financial assets.  
  
On March 29, 2022, the Board of Supervisors took action to authorize the closure of the former Los Medanos Community Healthcare District financial, investment, and business accounts as part of its responsibility as successor agency to the former District. Additionally, any remaining proceeds in such accounts were authorized to be remitted to the County Treasury for use in the former District area.  
  
Approval of the requested revenue and appropriation adjustments will establish the fiscal year 2021/22 budget for costs related to the transition of the former Los Medanos Community Healthcare District to the County. Due to the timing of the District's dissolution, a budget for fiscal year 2022/23 has not been established. It will be submitted for Board approval and authorization in October.

CONSEQUENCE OF NEGATIVE ACTION:

If this action is not approved, appropriations will not be properly allocated in FY 2021/22 for the costs related to the transition of the former Los Medanos Community Healthcare District to the County.
