RECOMMENDATION(S):

AUTHORIZE the Auditor-Controller, or designee, to pay up to $96,774 to Hobbs Investments, Inc. (dba AM-TRAN) for courier services provided during the period of December 1, 2021, through January 31, 2022.

FISCAL IMPACT:

This action will result in expenditures of up to $96,774 and will be funded by 51% Hospital Enterprise Fund I revenues and 49% American Rescue Plan Act funding.













BACKGROUND:

The routine utilization of courier services throughout the Health Services Department has been significantly impacted by the COVID19 pandemic. In 2021, the department experienced a 49% increase of courier services usage over the previous year. Laboratory courier services are responsible for maintaining regulatory requirements for proper handling of bio-hazardous material during transport and ensuring the integrity of the specimen until it reaches its final destination. This includes providing a continuous temperature-controlled environment; specimen tracking and timely deliveries. Due to COVID-19 physicians are ordering significantly more lab tests to accurately diagnose and treat their patients. Diagnostic Imaging has also experienced a growth in their volume as the need for courier services to transport films and images to and from other hospitals has increased. The Pharmacy courier volume has grown as they continue to courier stat medication orders to the clinics and jails all over the county.  
  
Due to this oversight, AM-TRAN was not paid by CCRMC for services provided in good faith. Therefore, CCRMC has determined that Hobbs Investments, Inc. (dba AM-TRAN) is entitled to payment for the value courier services provided under the equitable relief theory of quantum meruit. The theory provides that where a vendor has been requested to provide products or services without a valid purchase order, and the vendor does so to the benefit of the recipient, the vendor is entitled to recover the reasonable value of those products or services.

CONSEQUENCE OF NEGATIVE ACTION:

If this request is not approved, CCRMC will be unable to pay Hobbs Investments, Inc. (dba AM-TRAN) for courier services provided in good faith and could cause a disruption to CCRMC’s reliance on this vendor's support for the transport of specimens, films, and medication throughout the county.
