RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a Consulting Services Agreement (contract) amendment with WSP USA Inc., to extend the term from July 31, 2021 through July 31, 2022, for on-call construction management services, with no change to the payment limit of $350,000, Countywide. (All Districts)

FISCAL IMPACT:

There is no fiscal impact as the amendment is to extend the term only. Work performed under this on-call contract is funded by developer fees, local, state and federal funds for local road, flood control, and airport projects.

BACKGROUND:

The Public Works Department is involved in various projects in the County which require construction management services for road, flood control, and airport projects. After a solicitation process in 2018, this firm was selected as one of the seven firms to provide construction management services on an “on-call” basis and was awarded an on-call consulting services agreement for construction management services at the July 24, 2018, Board of Supervisors meeting.

BACKGROUND: (CONT'D)

Since the original consulting services agreement was executed, the Consultant has provided on-call construction management services on multiple projects. While most of these projects have been completed, the Storm Damage Repair Project: Alhambra Valley Road at Ferndale, 0672-6U6211; Alhambra Valley Road west of Castro Ranch Road, 0672-6U6225; Bear Creek Road Embankment Repairs, 0672-6U6226 (project) are on-going and requires Consultant’s services beyond the Agreement’s July 31, 2021, expiration. These construction management services are needed to support the construction phase of the project and began on June 1, 2021, with pre-construction and construction services. Construction completion is expected by the end of 2021. The County will need construction management services from WSP USA Inc., for this project through July 31, 2022, which includes project closeout services after completion of construction. An extension of the on-call agreement is needed through July 31, 2021, to align with the County’s needs for construction management services for the project. The current on-call agreement payment limit of $350,000 is sufficient for the proposed work and will not need to be amended.

This contract includes services provided by represented classifications, and the County has met its obligations with the respective labor partner(s).

CONSEQUENCE OF NEGATIVE ACTION:

Without approval from the Board of Supervisors, this contract amendment will not be in effect. This will result in delays to the Storm Damage Repair Project and added costs as the County solicits for new professional services which will duplicate previous work.
