RECOMMENDATION(S):

As the governing body of the Contra Costa County Flood Control and Water Conservation District (District), APPROVE the License Agreement with Crown Castle GT Company, LLC, for the use of a portion of the San Ramon Creek right of way (Assessor’s Parcel Number 192-082-004), in Alamo, for a term beginning January 21, 2020 through December 30, 2025, with two five-year renewal options. The annual fee for the first five years is $12,000 with a $2,000 increase for each renewal option.  
  

AUTHORIZE the Chief Engineer, or designee, to execute, on behalf of the District, the License Agreement and to exercise any options to extend the license term.  




FISCAL IMPACT:

The term begins January 21, 2020 through December 30, 2025, with two five-year renewal options. The annual fee for the first five years is $12,000 with a $2,000 increase for each renewal option.The District will receive revenue that will be applied 100% to Flood Control Zone 3B.

BACKGROUND:

On February 24, 1998, the District and GTE Mobilnet, as the original licensee, entered into an agreement to access and maintain their telecommunication tower through the District-owned property. The License Agreement was assigned to Crown Castle GT Company, LLC on July 6, 2015 and expired on January 31, 2016. In order to continue the use of the property and provide access to their telecommunication tower, Crown Castle GT Company, LLC and the District desire to enter into a new license agreement.

CONSEQUENCE OF NEGATIVE ACTION:

If this license agreement is not approved, the District’s Flood Control Zone 3B will not receive revenue during the term of this agreement.
