RECOMMENDATION(S):

RECEIVE public report of litigation settlement agreements that became final during the period of June 1, 2019, through June 30, 2019, as recommended by County Counsel.

Settlement amounts are listed below.

BACKGROUND:

Three agreements to settle pending litigation, as defined in Government Code section 54956.9, became final during the period of June 1, 2019, through June 30, 2019.

BACKGROUND: (CONT'D)

Bassem Banafa v.Contra Costa County, et al., USDC Case No. C18-01642 TSH (N.D. Cal.). On May 7, 2019, the Board of Supervisors approved settlement of this employment lawsuit. The Board authorized settlement in the amount of $80,000, inclusive of attorneys fees and costs, in closed session by a 5-0 vote. The settlement agreement was fully executed on June 25, 2019. The funding source is the Risk Management Liability Internal Service Fund.

Suneel Kumar v. Contra Costa County, et al., USDC Case No. C19-00029 DMR (N.D. Cal.). On May 14, 2019, the Board of Supervisors approved settlement of this civil rights personal injury lawsuit. The Board authorized settlement in the amount of $90,000, inclusive of attorneys fees and costs, in closed session by a 4-0 vote, Supervisor Glover absent. The settlement agreement was fully executed on June 3, 2019. The funding source is the Risk Management Liability Internal Service Fund.

Amir Allison, et al. v. Contra Costa Regional Medical Center, et al, C.C.C. Sup. Ct. Case No. C17-02342. On June 11, 2019, the Board of Supervisors approved settlement of this medical malpractice lawsuit. The Board authorized settlement in the amount of $850,000, inclusive of attorneys fees and costs, in closed session by a 5-0 vote. The settlement agreement was fully executed on June 25, 2019. The funding source is the Risk Management Medical Malpractice Internal Service Fund.

This report includes final settlements of litigation matters handled by the Office of the County Counsel. This report does not include litigation settlements that were reported by the Risk Management Division of the County Administrator's Office as a consent item on the Board's open session agenda.

CONSEQUENCE OF NEGATIVE ACTION:

The report would not be accepted.
