RECOMMENDATION(S):

ADOPT Resolution No. 2018/445, approving a side letter between Contra Costa County and the Deputy Sheriff's Association (DSA), Management Unit, to incorporate provisions for the classification of Sheriff's Communication Center Director (64NC) into the DSA, Management Unit Memorandum of Understanding

FISCAL IMPACT:

Structured to be cost neutral. This is a change of classification representation between Local 21 and the Deputy Sheriffs Association.

    On October 31, 2017 the Deputy Sheriffs Association (DSA) filed a request with the Employee Relations Officer to modify the Supervisory Unit of IFPTE, Local 21 to establish a new unit known as the Sheriff’s Communication Center Director Unit, and for formal recognition of DSA as the majority representative for the proposed unit. A preliminary determination of appropriateness determined that the proposed representation unit was not appropriate and a meet and confer was scheduled to see if an agreement could be reached on the composition of an appropriate representation unit. A meet and confer occurred on January 8, 2018 and an agreement was reached to incorporate the Sheriff’s Communication Center Director into the Management Unit of the DSA Management Memorandum of Understanding (MOU).

      
    The attached Deputy Sheriffs Association, Management MOU has been modified in the following ways:

    1. The classification of Sheriff’s Communication Center Director (64NC) has been added to Section 1.1 Association Recognition.
    2. A new Section, 10.6 Workers Compensation and Continuing Pay for Non-Sworn Employees has been added to allow for non-sworn employees to be eligible for Workers’ Compensation.
    3. Added language to allow non-sworn employees to be eligible for Annual Management Administrative Leave in section 15.3 (A).
    4. Added language to Section 22(A) to clarify that both General and Safety members are responsible for payment of 100% of employees’ basic retirement benefit contributions.
    5. Added Commuter Benefit Program language to Section 24.
    6. Created new Section 36 for a Dispatch Reopener in the event of a consolidation of Sheriff Dispatch operations with Fire Dispatch operations.
    7. Subsection numbering was changed in Sections 10.6, 37, and 38.

    CONSEQUENCE OF NEGATIVE ACTION:

    If the side letter is not approved, the terms and conditions of employment for the classification will not be included in the DSA memorandum of understanding.
