RECOMMENDATION(S):

RESCIND Traffic Resolution No. 2004/4082, and ADOPT Traffic Resolution No. 2018/4471 to establish speed limits on Orwood Road (Road No. 8963), as recommended by the Public Works Director, Brentwood area.   

FISCAL IMPACT:

No fiscal impact.  

BACKGROUND:

Local law enforcement agencies requested the Public Works Department Traffic Engineering perform an Engineering and Traffic Survey (E&TS) to enable speed enforcement by their forces on Orwood Road. A valid E&TS is a requirement by courts where law enforcement agencies use Radar/Lidar devices to enforce speed limits.  
  


BACKGROUND: (CONT'D)
Orwood Road is classified as a local highway by the Federal Highway Administration. Speed limits shall be set according to standards established in the California Manual on Uniform Traffic Control Devices (CA MUTCD) and California Vehicle Code (CVC) Section 22358, if the speed limit is to be set lower than the prima facie speed limit of 55 miles per hour. These standards require an Engineering and Traffic Survey (E&TS) to be conducted to establish an enforceable speed limit.  

CONSEQUENCE OF NEGATIVE ACTION:

Law enforcement would not be able to enforce speed limits on Orwood Road using Radar and Lidar devices.
