RECOMMENDATION(S):

APPROVE and AUTHORIZE the Conservation and Development Director, or designee, to execute a contract with Environmental Science Associates (ESA) in an amount not to exceed $451,987 for the preparation of a Recirculated Environmental Impact Report for the Phillips 66 Propane Recovery Project located in the Phillips 66 Refinery in the Rodeo area, for the period June 25, 2018 through June 30, 2020. (County File #LP12-2073)

FISCAL IMPACT:

There will be no impact to the General Fund. The entire cost will be borne by the applicant and paid to the County in the form of land use permit review fees.


BACKGROUND:

The Contra Costa County Department of Conservation and Development is the "Lead Agency" under the California Environmental Quality Act (CEQA) for the environmental review of the proposed Phillips 66 Propane Recovery Project (County File #LP12-2073). The project was approved by the Board of Supervisors on February 3, 2015, which approval and environmental review was subsequently set aside by the Superior Court of the State of California on March 16, 2017. In response, the applicant has reapplied to implement the project, and ESA has been retained by the County to prepare a Recirculated Draft Environmental Impact Report and Final Environmental Impact Report for the project.

CONSEQUENCE OF NEGATIVE ACTION:

There will be no contract for the consultant to prepare the necessary revised Environmental Impact Report for implementation of the the Propane Recovery Project.

CHILDREN'S IMPACT STATEMENT:

The preparation of an Environmental Impact Report will not have any negative impacts on children or children's resources in the County.
