RECOMMENDATION(S):

As the governing body of the Contra Costa County Flood Control and Water Conservation District (District), APPROVE and AUTHORIZE the Chief Engineer, or designee, to execute the Right of Way Contract-Temporary Construction Easement and ACCEPT the Access Easement from West County Landfill, Inc., granting to the District the property rights in connection with the San Pablo and Wildcat Creeks Levee Remediation Project, Richmond area. (District I)

FISCAL IMPACT:

No Fiscal Impact.

BACKGROUND:

On July 7, 2015, this Board approved the proposed project and adopted the Mitigated Negative Declaration pertaining to the Project SCH #2015052028. These property rights are required for the San Pablo and Wildcat Creek Levee Remediation Project in accordance with the approved plans and specifications.

CONSEQUENCE OF NEGATIVE ACTION:

The project will not have sufficient land rights to allow construction in accordance with the approved plans and specifications.
