RECOMMENDATION(S):

RESCIND board action of May 24, 2016 (C. 80) approving and authorizing the Public Works Director, or designee, to execute a Consulting Services Agreement with Loving Campos Associates, Architects, Inc. for new Fire Station No. 16 due to Contra Costa County Fire Protection District becoming the party to the Consulting Services Agreement with Loving Campos Associates, Architects, Inc.

There is no fiscal impact.

On May 24, 2016, the Board of Supervisors approved Board action C. 80, approving and authorizing the Public Works Director, or designee, to execute a Consulting Services Agreement with Loving Campos Associates, Architects, Inc. (LCA) in an amount not to exceed $455,913, to provide architectural services for New Fire Station No. 16, 4007 Los Arabis Road, Lafayette.  
  
Contra Costa County Fire Protection District owns the property located at 4007 Los Arabis Road, Lafayette where Station 16 is located. Because the Fire District owns the property on which new Fire Station 16 will be built, it should be the party to the Consulting Services Agreement with LCA instead of the County. On June 14, 2016, the Fire District Board of Directors approved and authorized the Fire Chief, or designee, to execute a Consulting Services Agreement with LCA in an amount not to exceed $455,913, to provide architectural services for new Fire Station No. 16 at 4007 Los Arabis Road in Lafayette.  
  
Because the Fire District has entered into a Consulting Services Agreement with LCA for architectural services for new Fire Station No. 16, the approval and authorization of a Consulting Services Agreement between the County, and LCA is no longer necessary.

CONSEQUENCE OF NEGATIVE ACTION:

If the rescission is not approved, the Public Works Director will continue to possess unnecessary authority to execute the Consulting Services Agreement with LCA for services that will not be used.
