RECOMMENDATION(S):

ADOPT Resolution No. 2016/437 approving the third extension of the Road Improvement Agreement (Right-of-Way Landscaping) for road acceptance RA09-01245 (cross-reference SD07-08970), for a project being developed by Shapell Homes, a Division of Shapell Industries, Inc., a Delaware Corporation, as recommended by the Public Works Director, San Ramon (Dougherty Valley) area. (District II)

FISCAL IMPACT:

No fiscal impact.

BACKGROUND:

The terminal date of the Road Improvement Agreement (Right-of-Way Landscaping) needs to be extended. (Approximately 100% of the work has been completed to date.) The developer is working on completing the punch list items.

CONSEQUENCE OF NEGATIVE ACTION:

The terminal date of the Road Improvement Agreement (Right-of-Way Landscaping) will not be extended and the developer will be in default of the agreement, requiring the County to take legal action against the developer and surety to get the improvements installed, or revert the development to acreage.
