RECOMMENDATION(S):

ADOPT Resolution No. 2016/430 approving the third extension of the Road Improvement Agreement (Right-of-Way Landscaping) for road acceptance RA04-01168 (cross-reference SD04-8856), for a project being developed by Shapell Homes, A Division of Shapell Industries, Inc., A Delaware Corporation, as recommended by the Public Works Director, San Ramon (Dougherty Valley) area. (District II)  

FISCAL IMPACT:

No fiscal impact.  

BACKGROUND:

The terminal date of the Road Improvement Agreement (Right Of Way Landscaping) needs to be extended. (Approximately 100% of the work has been completed to date.) The development is in the warranty period and the bond needs to be kept up to date.  



CONSEQUENCE OF NEGATIVE ACTION:

The terminal date of the Road Improvement Agreement (Right Of Way Landscaping) will not be extended and the developer will be in default of the agreement, requiring the County to take legal action against the developer and surety to get the improvements installed, or revert the development to acreage.
