RECOMMENDATION(S):

ADOPT Resolution No. 2022/194 approving the submission of a claim to the Metropolitan Transportation Commission (MTC) to seek Fiscal Year 2022/2023 Transportation Development Act (TDA) funding in the amount of $1,403,400 for bicycle and pedestrian projects sponsored by the County and the Cities of Brentwood, Concord, Moraga, Orinda, Pittsburg, Pleasant Hill, Richmond, San Pablo, and San Ramon; and DIRECT the Public Works Director, or designee, to forward the claim to MTC for final approval and final allocation of funding, effective July 1, 2022, Countywide.

FISCAL IMPACT:

100% Transportation Development Act, Article 3 Funds.











BACKGROUND:

Article 3 of the TDA, Public Utilities Code (PUC) Section 99200 et seq., authorizes submission of claims to a regional transportation planning agency for the funding of projects exclusively for the benefit and/or use of pedestrians and bicyclists. The MTC, as the regional transportation planning agency for the San Francisco Bay region, has adopted MTC Resolution No. 4108 delineates procedures and criteria for submission of requests for the allocation TDA Article 3 funds. Each claimant whose project or projects have been prioritized for inclusion in the Fiscal Year 2022/2023, TDA Article 3 Countywide coordinated claim is required to submit a resolution from its governing body to MTC requesting an allocation of TDA Article 3 funds.  
  
On March 3, 2022, four members of the City-County Engineering Advisory Committee (CCEAC), and three members of the Countywide Bicycle Advisory Committee (CBAC) performed a Zoom review of the project applications. At that time, the allocation from Metropolitan Transportation Commission (MTC) was estimated at $1,403,400. The funding recommendations for those projects were approved by the CCEAC at their March 17, 2022, meeting, and subsequently approved by the Contra Costa Mayor’s Conference at their April 7, 2022, meeting.

CONSEQUENCE OF NEGATIVE ACTION:

Failure to approve the recommendation and forward the list will eliminate a potential funding source.
