RECOMMENDATION(S):

APPROVE and AUTHORIZE the Fire Chief, or designee, to execute an agreement terminating the Station 70 MOU with the City of San Pablo upon satisfaction of all conditions precedent, Notice of Termination of Agreement, and Grant Deed to the City of San Pablo for the old Fire Station 70 property in San Pablo.

FISCAL IMPACT:

This action allows the Contra Costa County Fire Protection District (District) to collect a final payment from the City of San Pablo associated with this final step of the project. There are no new fiscal impacts associated with this step.

BACKGROUND:

On May 9, 2017, the Board of Directors authorized the execution of a Memorandum of Understanding (MOU) for the relocation and building of Fire Station 70 in San Pablo. Since that time, the station has been fully constructed and the crews are now responding to emergency calls from the new station. The final steps in this project are to: 1) execute the termination of the MOU, and 2) transfer the legal ownership of the former Fire Station 70 site to the City of San Pablo according to the terms and conditions as contained in the MOU. This proposed action allows the Fire Chief or designee to execute those documents and finalize and close this multi-year effort and partnership with the City of San Pablo.

CONSEQUENCE OF NEGATIVE ACTION:

The District would be out of compliance with the terms and conditions of the Memorandum of Understanding.
