RECOMMENDATION(S):

APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County Contract Extension Agreement #23-710-1 with Fulgent Therapeutics, LLC, a limited liability company, effective May 28, 2021, to extend the termination date from June 14, 2021 through June 30, 2022, to continue to provide COVID-19 clinical laboratory services.

FISCAL IMPACT:

There is no change in the original funding of $350,000 which is funded by 100% Federal and State emergency COVID-19 funding.

BACKGROUND:

This contract establishes a relationship between CCHS and the contractor to increase the County's ability to processes laboratory specimens related to COVID-19 testing collected throughout the County and reduce delays in receiving test results. Fulgent Therapeutics, LLC is an independent laboratory that has the facilities and expertise to provide COVID-19 testing to physicians, hospitals, laboratories and other entities including employers qualified to purchase and provide COVID-19 testing services to individuals.  




BACKGROUND: (CONT'D)
  
On March 23, 2021, the Board of Supervisors approved Contract #23-710 for this contractor to provide clinical laboratory services for CCHS, for the period March 15, 2021 through June 14, 2021. This contract includes mutual indemnification to hold harmless both parties for any claims arising out of the performance of this contract.  
  
Approval of Contract Extension Agreement #23-710-1 will allow this contractor to continue providing services through June 30, 2022.

CONSEQUENCE OF NEGATIVE ACTION:

If this contract extension is not approved, the department will not have access to this contractor's laboratory specimen processing related to COVID-19, and significantly delay the department's ability to recieve timely test results.
