RECOMMENDATION(S):

APPROVE and AUTHORIZE the Auditor-Controller, or designee, to pay $334,389.58 to Bi-Bett, a non-profit corporation, for substance use disorder prevention, treatment, and detoxification services provided in good faith for the period July 1, 2019 through March 31, 2020, as recommended by the Health Services Director.

FISCAL IMPACT:

This retro payment in the amount of $334,389.58 is funded by 52% Substance Abuse Treatment and Prevention Block Grant ($172,374.43); 46% Federal Medi-Cal ($154,459.40); 2% Assembly Bill 109 ($7,555.75) revenues.

BACKGROUND:

The Behavioral Health Services Department has been contracting with Bi-Bett, since May 2002 to provide substance use disorder prevention, treatment, and detoxification services for County residents referred through the Behavioral Health Access Line. This Contract meets the social needs of County’s population by providing specialized substance use disorder treatment services so that men and women, including women with children, are provided an opportunity to achieve and maintain sobriety and to experience the associated benefits of self-sufficiency, family reunification, cessation of criminal activity and productive engagement in the community.

On July 30, 2019, the Board of Supervisors approved Contract #74-174-32 with Bi-Bett, in the amount of $5,699,003 to provide substance use disorder prevention, treatment, and detoxification services for the period July 1, 2019 through June 30, 2020.  
  
On April 28, 2020, the Board of Supervisors approved Amendment Agreement #74-174-33, to modify the rate schedule due to COVID-19 with no change in the Payment Limit or term.  
  
The request to modify the cost per unit due to higher than anticipated utilization was delayed, and the contract expired before the amendment was processed. Bi-Bett continued to provide substance use disorder prevention, treatment, and detoxification services in good faith for the period July 1, 2019 through March 31, 2020, which exceeded the payment limit by $334,389.58.

  
Therefore, the County has determined that Bi-Bett, is entitled to payment for the reasonable value of their services under the equitable relief theory of quantum meruit. That theory provides that where a person has been asked to provide services without a valid contract, and the provider does so to the benefit of the recipient, the provider is entitled to recover the reasonable value of those services.

CONSEQUENCE OF NEGATIVE ACTION:

If this request is not approved, Bi-Bett will not be paid for services provided to County clients outside of the contract payment limit and rendered in good faith.
