RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director and the Chief Engineer, or designee, to enter into a Master License Agreement between Contra Costa County, Contra Costa County Flood Control and Water Conservation District and East Bay Regional Park District for the operation and maintenance of the Iron Horse Trail within the Iron Horse Corridor.

FISCAL IMPACT:

There is no fiscal impact.

BACKGROUND:

On October 14, 1986, Contra Costa County (County) and East Bay Regional Park District (District) entered into a license agreement entitled License-San Ramon Valley Trail, covering the construction, use and maintenance of a public trail located on a portion of the land referred to in the original license as the “former Southern Pacific Right of Way” and currently referred to as the Iron Horse Corridor (IHC). During the term of the license agreement, the County and District approved six (6) license agreement amendments.  




BACKGROUND: (CONT'D)
  
On October 9, 1990, the Contra Costa Redevelopment Agency (Agency) and District entered into a license agreement entitled Iron Horse Trail, covering the use and maintenance of a public trail located on a portion of land referred to as the “former Southern Pacific Right of Way.” The Agency and District approved three (3) license agreement amendments.  
  
On July 9, 2019, the County accepted the grant deed conveying thirteen (13) former Redevelopment Agency owned parcels in the Iron Horse Corridor, recorded August 27, 2019, as Document No. 2019-0138269.  
  
County, Flood Control, and District staff reviewed both license agreements and subsequent amendments to incorporate into a new master license agreement. The new twenty-five (25) year master license agreement will allow the District to operate and maintain the Iron Horse Trail in the IHC from Monument Boulevard in Concord to the Alameda County line.

CONSEQUENCE OF NEGATIVE ACTION:

The District will not have a current license agreement to operate and maintain the Iron Horse Trail.
