RECOMMENDATION(S):

APPROVE and AUTHORIZE the conveyance of Contra Costa County property in connection with the I-80 San Pablo Dam Road Interchange Project in San Pablo, to the State of California, Department of Transportation (Caltrans), pursuant to Streets & Highway Code§ 960, as recommended by the Public Works Director, San Pablo area. (Project No.: 4660-6X4170); and  
  

DETERMINE said property to be surplus and no longer necessary for county purposes, but is required by the State for highway purposes; and  

  

RECOMMENDATION(S): (CONT'D)
AUTHORIZE the Chair, Board of Supervisors, to execute a Grant Deed, Quitclaim Deed and Easement Deed (Deeds) on behalf of the County; and  
  
DIRECT the Real Estate Division of the Public Works Department to cause said Deeds and a certified copy of this Board Order to be delivered to the State for acceptance and recording in the Office of the County Clerk-Recorder.   

FISCAL IMPACT:

Contra Costa Transportation Authority (CCTA) will pay the actual costs for Public Works Real Estate Division right of way services.  

BACKGROUND:

In 2013, CCTA in cooperation with the State of California, acting by and through Caltrans, and the City of San Pablo, proposed to reconstruct the Interstate 80 (I-80)/San Pablo Dam Road Interchange (Project).  
  
On June 25, 2013, this Board approved the adoption of the previously approved Caltrans Mitigated Negative Declaration for the Interchange Project, in compliance with the California Environmental Quality Act; which included real estate transactions. [DCD-CP#13-25] [SCH# 2009082009]).  
  
Under a Real Property Services Agreement with CCTA, Contra Costa County (County) acquired the real property in San Pablo, CA, as described whereto in the Deeds, for highway purposes.  
  
Construction of the Project has been completed and it’s been determined that the acquired real property is no longer required for County purposes, but is required by the State for highway purposes.  

CONSEQUENCE OF NEGATIVE ACTION:

Without board approval of this conveyance, the County will be responsible for the maintenance property meant for the State for highway purposes.
