RECOMMENDATION(S):

ADOPT Position Adjustment Resolution No. 25747 to add one (1) full-time Assistant County Counsel - Exempt (2ED1) (unrepresented) position at Salary Plan and Grade B8E 2385 ($14,715.52 - $17,886.80) in the Office of the County Counsel.

FISCAL IMPACT:

Upon approval, the internal appointment of the County Counsel creates a vacancy factor in the Chief Assistant County Counsel position. The Assistant County Counsel position will utilize the salary savings from the Chief Assistant County Counsel vacancy, in addition to any client billings, to cover the cost of the additional position. The estimated annual cost of the position will be $290,000 (both salary and benefits), including $47,300 of pension costs.

BACKGROUND:

The recent loss of the County Counsel requires the Office of the County Counsel to realign the supervising attorney management team. The purpose of this action is to enable the Office of the County Counsel to appoint an attorney who has the specialized training and experience in the areas of labor and employment law, so that the Office can efficiently and effectively satisfy the County's legal needs.

CONSEQUENCE OF NEGATIVE ACTION:

Foreseeable, potential consequences of a decision not to approve this request may be department inefficiencies, mainly disruption in the provision of critical legal services.
