RECOMMENDATION(S):

APPROVE Appropriation Adjustment No.005046 in the amount of $385,100 to transfer appropriations from Probation to the Public Works Department to reconfigure the common shower room / restroom area in the Tamalpais housing unit at the Juvenile Hall.

FISCAL IMPACT:

Probation appropriations for salaries and benefits will be reduced by $385,100 and transferred to Public Works. 100% County General Fund.

BACKGROUND:

On July 1, 2021 the Division of Juvenile Justice (DJJ) will no longer accept, house, and provide treatment for youth ordered held as the result of their criminal proceedings. SB 823 mandates these youth be housed and cared for in their county of commitment. The Tamalpais housing unit is critical to the success of the planned treatment programs available to the youth. The current configuration of the shower / restroom area does not meet the privacy or safety mandates of PREA or Title 24, leaving the Department vulnerable to possible sanction by the Board of State and Community Corrections


CONSEQUENCE OF NEGATIVE ACTION:

Appropriations will not be properly allocated.
