RECOMMENDATION(S):

APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County Contract #23-074-41 with Foley & Lardner, LLP, a limited liability partnership, in an amount not to exceed $450,000, for the provision of legal services related to Medi-Cal audit appeals and other Contra Costa Health Plan appeals, report issues, and authorized litigation issues, for the period from July 1, 2019 through June 30, 2020.

FISCAL IMPACT:

This Contract is funded by 100% by Hospital Enterprise I Fund. (No rate increase)  
  


BACKGROUND:

Since 1985, this Contractor, which specializes in health care law, has been providing legal services in the form of consultation, research, opinion, advice and representation for the Health Services Director with regard to Medi-Cal audit appeals and other Contra Costa Health Plan appeals, report issues, and authorized litigation issues.  
  
On May 22, 2018, the Board of Supervisors approved Contract #23-074-40 with Foley & Lardner, LLP, for the period from July 1, 2018 through June 30, 2019 for the provision of temporary legal services with regard to Medi-Cal audit appeals and other authorized litigation issues.   
  
Approval of Contract #23-074-41 will allow the Contractor to continue to provide specialized legal services, as requested by the Health Services Director, through June 30, 2020. This contract includes mutual indemnification.  

CONSEQUENCE OF NEGATIVE ACTION:

If this contract is not approved, the County will not be able to receive specialized services with regard to Medi-Cal audit appeals and other Departmental Health Plan appeals, report issues, and authorized litigation issues.
