RECOMMENDATION(S):

ADOPT Resolution No. 2018/206 approving and authorizing the District Attorney, or designee, to enter into a three year Memorandum of Understanding with the California Department of Insurance and the California Highway Patrol, including modified indemnification language, formalizing operational commitments for a coordinated effort aimed at the investigation and prosecution of organized automobile fraud activity, pursuant to State guidelines.

BACKGROUND:

The State Legislature has determined that organized automobile fraud activity operating in major urban centers of the state represents a significant portion of all individual fraud-related automobile insurance cases. This fraudulent activity drives higher insurance premiums in certain urban and low income areas of the state, requiring coordinated effort by local and state agencies to combat the problem. California Insurance Code section 1874.8 requires the Department of Insurance to award between three and 10 grants to coordinated programs targeted at successful prosecution and elimination of organized automobile fraud activity. All participants receiving grant funding are required to coordinate their efforts and work in conjunction with the California Department of Insurance, other participating agencies, and all interested insurers to reduce automobile insurance fraud activity and lessen the economic losses realized by insurers from that fraud.  
  
Failure to enter into a Memorandum of Understanding with the California Department of Insurance and the California Highway Patrol will result in the inability of the District Attorney to apply for State funds designated for use by Contra Costa County in the investigation and prosecution of automobile insurance fraud. A necessary component of the application for grant funding is a Memorandum of Understanding, and a county which fails to submit a complete application shall not be considered for grant funding.  

CONSEQUENCE OF NEGATIVE ACTION:

The District Attorney will be unable to apply for the grant funding.
