RECOMMENDATION(S):

APPROVE and AUTHORIZE the Treasurer/Tax Collector, or designee, to execute a contract with KUBRA America West, Inc. including modified indemnification, in the amount of $99,000.00 to provide an enterprise payment solution so the County’s customers can pay property taxes and assessments, goods and/or services by credit card, debit card, and electronic checks for the period of July 1, 2018 through June 30, 2021.  

FISCAL IMPACT:

Under the terms of the contract, taxpayers (customers) are charged a service fee of 2.5% for credit card, $3.25 for debit card transactions. Electronic Checks (ACH) are County absorbed at $0.08 per transaction. (A fraction of the cost of a paper check).









BACKGROUND:

The County Treasurer-Tax Collector has used KUBRA America West, Inc. to process property tax payments online, by phone (through an interactive voice response system), and in-person for credit card, debit card and electronic check transactions since July 2013. The Treasurer-Tax Collector issued a Request for Proposal in July 2017 and awarded the contract to KUBRA America West, Inc. While the cost associated with each transaction by credit and debit card will be paid by the consumer, the cost associated with each transaction by electronic check will be charged to General County Investment Revenue Fund 817700 – consistent with other County banking fees.   
  
Under the software and services agreement, the County is obligated to indemnify KUBRA for third party claims arising out of the County's breach of the agreement or payer payment disputes.  

CONSEQUENCE OF NEGATIVE ACTION:

The Treasurer-Tax Collector will not have the ability to process credit card payments for property taxes.
