RECOMMENDATION(S):

APPROVE and AUTHORIZE the Sheriff-Coroner, or designee, to execute a contract, including mutual indemnification, with the Contra Costa Water District in an amount not to exceed $300,000 yearly, to provide law enforcement services at the Los Vaqueros Reservoir for the period July 1, 2018 through June 30, 2019, and to automatically renew annually for one (1) term unless terminated by either party.

FISCAL IMPACT:

$300,000 Revenue. No net County cost. Budgeted.


BACKGROUND:

Since October 1999, the Sheriff's Office has provided law enforcement services to the Contra Costa Water District at the Los Vaqueros Reservoir. In the past, the Watershed provided a vehicle for use by the assigned deputy and there was no contract clause permitting the deputy to store a long gun safely on the Watershed property. This contract needs to be modified by agreement of the parties to shift responsibility for providing a fully equipped emergency vehicle to the Office of the Sheriff and define the financial obligation for the Watershed to pay for and maintain that vehicle. This contract modification will also provide for the installation of a safe in the Watershed Offices for the storage of a long gun for use by the assigned deputy sheriff. This Interagency Agreement includes mutual indemnification.

CONSEQUENCE OF NEGATIVE ACTION:

Should the Board of Supervisors opt not to approve this order, the Watershed will be responsible for replacing the current vehicle with a vehicle purchased by the Water District, which may not be equipped with emergency equipment to the standard of the Office of the Sheriff. Additionally, the Office of the Sheriff will not enable the assigned deputy to store a weapon on site, causing unnecessary delay in the deputy being required to drive to the nearest station to obtain the weapon.
