RECOMMENDATION(S):

  1. ADOPT Ordinance No. 2017-13 implementing community choice aggregation in unincorporated Contra Costa County by becoming a member agency of the Marin Energy Authority (Marin Clean Energy or MCE) joint powers authority.

  2. ADOPT Resolution No. 2017/210 requesting the Marin Energy Authority Board of Directors to approve Contra Costa County as a member agency of the Marin Energy Authority and include the unincorporated area of Contra Costa County within the Marin Energy Authority service area.

  3. APPROVE and AUTHORIZE the Director of Conservation and Development, or his designee, to execute, on behalf of the County, the attached memorandum of understanding with the Marin Energy Authority specifying how the parties will cooperate as the County seeks to participate in the authority.




RECOMMENDATION(S): (CONT'D)
  1. APPROVE and AUTHORIZE the County Administrator to execute, on behalf of the County, a declaration requesting that Pacific Gas & Electric Company (PG&E) provide current electricity load data within the unincorporated area of the County, pursuant to the non-disclosure agreement between the County and PG&E.
  2. DIRECT the Director of Conservation and Development, or his designee, to forward the County's application for membership in the Marin Energy Authority to the authority.

BACKGROUND:

Actions required to seek membership in MCE  
  
On May 2, 2017, the Board of Supervisors directed County staff to take the actions necessary for the County to seek membership in the Community Choice Energy program known as MCE. The Board materials for May 2, 2017 as well as from March 28, 2017 provide additional background on Community Choice Energy and the County's process for evaluating it. If approved, the actions recommended in this staff report will complete the actions required of the County to seek membership in MCE.  
  
At the May 2, 2017 meeting, MCE made certain representations to the County reflecting benefits MCE would provide to Contra Costa County if the County became a member of MCE. These benefits are described in Attachment E.  
  
Next Steps  
  
MCE has provided a timeline of events (Attachment F) that are expected to take place prior to implementation of electrical service for electricity customers within the County's jurisdiction should the County be accepted for membership to MCE. This timeline includes MCE's evaluation of the County's membership application, decision by MCE's Board of Directors whether to admit the County as a new member agency, appointment of the County's representative to MCE's Board of Directors, and commencement of a public outreach campaign to inform County residents and businesses of MCE's program implementation within the unincorporated area of the county.  
  
At this time, MCE estimates that public outreach concerning MCE's program launch in the unincorporated area of the county will begin in January 2018 and electrical service to the new MCE customers will begin in May 2018.

CONSEQUENCE OF NEGATIVE ACTION:

If the Board does not approve this item, the County will not be able to proceed with steps necessary to seek membership in MCE, as directed by the Board at its meeting on May 2, 2017.
