RECOMMENDATION(S):

RECEIVE this report concerning the final settlement of David Brown vs. Contra Costa County and AUTHORIZE payment from the Workers' Compensation Internal Service Fund, in the amount of $110,000 and waiver of court costs of $9,414.24.

FISCAL IMPACT:

Workers' Compensation Internal Service Fund payment of $110,000 and waiver of court costs.

BACKGROUND:

Attorney Mark A. Cartier, defense counsel for the County, has advised the County Administrator that within authorization an agreement has been reached settling the workers' compensation claim of David Brown vs. Contra Costa County. The Board's May 23, 2017 closed session vote was: Supervisors Gioia, Burgis, Mitchoff and Glover - Yes; Supervisor Andersen - Absent. This action is taken so that the terms of this final settlement and the earlier May 23, 2017 closed session vote of this Board authorizing is negotiated settlement are known publicly.

CONSEQUENCE OF NEGATIVE ACTION:

Case will not be settled.
