RECOMMENDATION(S):

APPROVE and AUTHORIZE the Conservation and Development Director, or designee, to execute, on behalf of Contra Costa County, a contract with Delta Energy Center, LLC, to pay the County an amount not to exceed $100,000 for building inspection services at the Delta Energy Center Project, in Pittsburg, during the period from May 16, 2017, and continuing until the County is paid for all services requested by the California Energy Commission.

FISCAL IMPACT:

The Department of Conservation and Development will receive Land Development fee revenue to offset the cost of providing building inspection services.

BACKGROUND:

The California Energy Commission (CEC) has requested the Department of Conservation and Development (DCD) provide building inspection services to Calpine for emergency repairs to Calpine’s Delta Energy Center in Pittsburg. Repairs are required to the facility following a recent fire on site. The facility is currently off-line and emergency repairs are needed to restore operations.  




BACKGROUND: (CONT'D)
  
The Delta Energy Center is a large power plant with capacity to produce up to 880 MW of electricity during normal operations. Delta Energy Center, LLC is a wholly owned subsidiary of Calpine. Such large power plants are under the regulatory jurisdiction of the CEC.   
  
The Delta Energy Center is an important component of the infrastructure that provides electricity to Northern California. The CEC is trying to get the facility back up and running in advance of the summer, which is peak time for energy usage. DCD has provided similar services at other power plants and has previously acted as the delegate Chief Building Official (CBO) under the CEC’s regulatory authority for large power generating facilities, including the Delta Energy Center. DCD's proven track record of performance resulted in the CEC selecting the County to provide building inspection services for the needed emergency repairs on short notice.  
  
Calpine is the owner of this facility and will compensate DCD for its services. This agreement is needed between Calpine and County so that DCD can proceed to provide the services. This agreement includes County billing rates that fully cover DCD's costs of providing such services.

CONSEQUENCE OF NEGATIVE ACTION:

If the proposed contract is not approved, the County will not be able to provide building inspection services as requested by the California Energy Commission.
