RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a Utility Relocation Agreement with Pacific Gas and Electric (Utility) for the Morgan Territory Road Slide Repair Project (Project), Clayton area. County Project No. 0672-6U6203/Federal Project No. pending (District III)  

FISCAL IMPACT:

The estimated cost for the right of way acquisition associated with this agreement is $12,000. All right of way acquisition costs associated with this utility work will be paid for by the County. Utility will pay for its construction costs to relocate their facility. County will later submit costs to the Federal Emergency Management Agency (FEMA) for reimbursement.   








BACKGROUND:

The Project proposes to reconstruct the damaged Morgan Territory Road, approximately one mile south of Marsh Creek Road in the unincorporated area of Contra Costa County. The Utility owns and maintains electric distribution facilities within the limits of the Project. In order to construct the Project, and at the Utility’s request, the County shall obtain temporary property rights to allow Utility to temporarily place their facilities in to accommodate the project Following completion of the project, Utility will remove their facilities from the temporary location and place the facilities in County’s road right of way. The purpose of this agreement is to provide for the apportionment of duties and costs between Contra Costa County and the Utility, including an indemnification statement for placement of Utility facilities within County owned temporary easements.   

CONSEQUENCE OF NEGATIVE ACTION:

If the agreement is not approved, construction of the Project will be halted, as the road cannot be repaired as proposed without relocation of the Utility’s facilities and the Federal Funds will be lost.
