RECOMMENDATION(S):

AUTHORIZE the Conservation and Development Director, or designee, to execute an amendment to the Operating Agreement with the Western Riverside Council of Governments for the HERO PACE (Property Assessed Clean Energy) Financing Program to modify and update the consumer disclosures in the Agreement.

FISCAL IMPACT:

None.

BACKGROUND:

On November 17, 2015, the Board of Supervisors (Board) approved an Operating Agreement with the Western Riverside Council of Governments (WRCOG) establishing terms and conditions for the operation of the HERO PACE financing program within the unincorporated area of the County. WRCOG has requested that the County modify and update the disclosures that are attachments to the Operating Agreement.  
  


BACKGROUND: (CONT'D)
On May 23, 2016, the Internal Operations Committee directed staff to prepare the attached amendment to the Operating Agreement with WRCOG for consideration by the Board. This amendment would modify and update the disclosures in the Operating Agreement. These changes will allow HERO program to more easily begin program operations within the unincorporated area so that PACE financing can be made available more quickly to property owners within the unincorporated area.

CONSEQUENCE OF NEGATIVE ACTION:

If the Board does not approve the recommended action, the disclosure materials in the Operating Agreement with the Western Riverside Council of Governments for the HERO PACE Financing Program will not be updated, which may cause delay in the operation of the HERO PACE Financing Program within the unincorporated area of the County.
