  Flora Eaton, Tom Shirley, Michael Floyd, David Nyberg (handout), John Abraham, Jeanne Coffey and Tracy Feng of Pubic Employees' Union Local 1, and Jeanne Coffey and Ange Cottone, CNA,  brought to the Board's attention the loss and difficulty of retaining staff in scientific fields such as medical laboratories ,results of a pay equity study in 1991 and actions taken at that time to equalize wages comparative to other counties, and a more recent study reflecting Contra Costa employees at a substantially lower compensation rate; and a recent severe recruiting problem countywide due to salary competition;

Joseph Partansky, resident of Concord, spoke on technical details of the Board's agenda in regard to the Better Goverment Ordinance and readability.

FOUND for purposes of compliance with the California Environmental Quality Act (CEQA), that the proposed action is not subject to the California Environmental Quality Act (CEQA);
ADOPTED Ordinance No. 2015-10, which amends the Alcoholic Beverage Sales Commercial Activities Ordinance to restrict the sale of alcopops under certain conditions and establish new posting requirements for alcohol retail sales locations, as amended today in regard to the font size on signage;
ADOPTED Resolution No. 2015/170, which approves Public Protection Committee and Planning Commission recommendations related to the Alcoholic Beverage Sales Commercial Activities Ordinance;

  D.13    CONSIDER accepting a report on PACE (Property Assessed Clean Energy) financing, and Direct the Department of Conservation and Development to implement an application process to enable PACE financing providers to apply to operate PACE financing programs in Contra Costa County, as recommended by the Internal Operations Committee.  (Supervisor Mitchoff; Jason Crapo, Conservation and Development Department)

County Counsel noted that a disclosure for the homeowner of the lien on the property is included in the operating agreement between the installer and the homeowner.  Supervisor Piepho requested it also be included in the permitting process to ensure the homeowner has clear understanding about the priority order of repayment of the loan (a senior lien), in the event the property owner desires to take such actions as sale of the property or refinancing of the mortgage;

Supervisor Andersen noted that Riverside County District Attorney's office has opened an investigation into a PACE program provider for suspected predatory lending practices.  She requested staff reach out to Riverside County to obtain further information on the status of that.

The Board discussed the valuation of the property using the amount listed on the Assessor's tax roll versus the fair market value. The current proposal is based on the assessed value of the property. It was noted other jurisdictions use whichever value is greater.  The Board expressed great concern about the risk of exposing the property owner to predatory lending practices. It was noted that the policy to use the more conservative basis of assessed value can be amended at a later date. The Board will move forward with the program in its current form to prevent delay in the implementation.

The Board ADOPTED the recommendations as presented today; DIRECTED the Conservation and Development Department to return to the Board at the last meeting in December 2015 with a report on such items as the actual staff cost of processing the application, how many applicants did or did not qualify, and any other pertinent statistics available.

GENERAL INFORMATION
The Board meets in all its capacities pursuant to Ordinance Code Section 24-2.402, including as the Housing Authority and the Successor Agency to the Redevelopment Agency. Persons who wish to address the Board should complete the form provided for that purpose and furnish a copy of any written statement to the Clerk.

Any disclosable public records related to an open session item on a regular meeting agenda and distributed by the Clerk of the Board to a majority of the members of the Board of Supervisors less than 72 hours prior to that meeting are available for public inspection at 651 Pine Street, First Floor, Room 106, Martinez, CA 94553, during normal business hours.

All matters listed under CONSENT ITEMS are considered by the Board to be routine and will be enacted by one motion. There will be no separate discussion of these items unless requested by a member of the Board or a member of the public prior to the time the Board votes on the motion to adopt. 

Persons who wish to speak on matters set for PUBLIC HEARINGS will be heard when the Chair calls for comments from those persons who are in support thereof or in opposition thereto. After persons have spoken, the hearing is closed and the matter is subject to discussion and action by the Board.  Comments on matters listed on the agenda or otherwise within the purview of the Board of Supervisors can be submitted to the office of the Clerk of the Board via mail: Board of Supervisors, 651 Pine Street Room 106, Martinez, CA 94553; by fax: 925-335-1913.
