RECOMMENDATION(S):

APPROVE the conveyance of surplus real property described in the Grant Deed, to Muir Heritage Land Trust (MHLT), a California non-profit corporation, pursuant to Government Code Section 25526.5. (Project No.: 4660-6X4152, SCH No. 95043029)  
  

DETERMINE that said property is no longer required for Contra Costa County (County) or other public purposes, and the value does not exceed $25,000.  

  

RECOMMENDATION(S): (CONT'D)
AUTHORIZE the Chair, Board of Supervisors, to execute a grant deed on behalf of the County.  
  
DIRECT the Real Estate Division of the Public Works Department to cause said grant deed to be delivered to the MHLT for acceptance and recording in the office of the County Clerk-Recorder.  

FISCAL IMPACT:

100% Contra Costa Transportation Authority Funds.

BACKGROUND:

In 1998 the Contra Costa Transportation Authority (CCTA) and the County entered into an Agreement for the County to provide right of way services for the State Route 4 - West Gap Project (Project). The terms of the Agreement included the County initially taking title for various property rights for the Project and to transfer those rights to the appropriate parties at a later date.  
  
In 2002 the County acquired the real property described in the Exhibit “A” as an uneconomic remainder, which value does not exceed $25,000, in connection with the State Route 4 West Gap Project, from Tosco, et al, described in the Final Order of Condemnation recorded August 27, 2002, document number 2002-0301156, Official Records of Contra Costa County.  
  
On May 13, 2014, the County conveyed a conservation easement over the adjacent property to MHLT, in accordance with Cooperative Agreement No. 4-1770C dated December 20, 2001. Since the surplus property is not required for county or other public purposes, the Real Estate staff has been directed by CCTA staff to convey the surplus property to Muir Heritage Land Trust.  

CONSEQUENCE OF NEGATIVE ACTION:

The County would continue to own property within the State Route 4 right of way and would not be in compliance with the Agreement.
