RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Defender, or designee, to execute a contract amendment and extension with Ali Saidi (DBA Law Office of Ali Saidi) to increase the payment limit by $52,000 to a new payment limit of $104,000 and to extend the term through November 10, 2015.

FISCAL IMPACT:

$12,000 for FY 14-15 (100% General Fund)
$40,000 for FY 15-16 (100% General Fund)

BACKGROUND:

This Agreement is between Ali Saidi (an Attorney specializing in immigration Law) and the Contra Costa County Public Defender's Office. In November of 2014, the County executed the Agreement for the Law office of Ali Saidi for an initial evaluation period of six (6) months to provide consultation to the Public Defender's Office, regarding the immigration consequences of criminal charges for Public Defender clients. The Public Defender has determined that this consulting service has proved to be essential for the non-citizen clients of the Office of the Public Defender, and seeks an extension of the Contract Agreement for an additional six (6) months, at the same compensation level.

CONSEQUENCE OF NEGATIVE ACTION:

The Department may not be in compliance with a Court Ruling that adequate legal representation, to non-citizen clients, requires advice regard the immigration consequences of criminal convictions.
