RECOMMENDATION(S):

APPROVE and AUTHORIZE the County Counsel, or designee, to execute, on behalf of the County, a contract with David F. Schmidt Professional Corporation, including modified indemnification language, in an amount not to exceed $195,000 to provide specialized professional legal services for the period July 1, 2015 through June 30, 2017.

FISCAL IMPACT:

This contract will be funded from the revenue the County Counsel's Office receives from fee charges. The contractor will be paid at the rate of $100 per hour. Payments under the contract are not to exceed $195,000.

BACKGROUND:

This contract will allow the County Counsel's Office to provide a continuity of specialized legal services to the Board of Supervisors and County departments, necessary for the continued operation of the County and Special districts. The contract may be terminated by the County Counsel upon three days notice to the contractor.

CONSEQUENCE OF NEGATIVE ACTION:

If the contract is not approved, necessary legal services may be disrupted or, potentially, would have to be procured at a higher rate from someone less familiar with the subject matter.
