  By unanimous vote with all Supervisors present, the Better Government Ordinance requirements for consideration of an item on today's agenda is waived. After the agenda for this meeting was posted, the county was advised by its outside counsel of grounds for an appeal in the case of California Department of Water Resources versus all persons interested in the matter, statement Superior Court case No. 34-2018-00246183, which is validating long term extensions of state water contracts related to the Delta tunnels project. And the time to file an appeal in this matter expires on June 2nd of 2022, before the board meets again.

By unanimous vote with all Supervisors present, The Board
voted to authorize an appeal in the case of California Department of Water Resources versus all persons interested in the matter. Sacramento Superior Court case No. 342018-00246183.

D.10  CONSIDER authorizing the Board of Supervisors, in all its capacities, and its subcommittees, and its advisory bodies to continue teleconference meetings under Government Code section 54953(e), make related findings, and take related actions.  (Mary Ann McNett Mason, County Counsel)
  ADOPTED the recommendations; DIRECTED that all relevant bodies provide the capability for persons, whether members of the body or the public, to participate in the meeting in a virtual manner via telephone or video meeting software. No meeting shall be held that cannot provide remote participation in the proceedings: and FURTHER DIRECTED the County Administrator to prepare and distribute a memo to all Department Heads advising of the new policy.

  No Name Given spoke on the continuing need for a noise ordinance in Discovery Bay and Brentwood and offered to assist in the purchase of a decibel meter if that would help. 
The Board clarifed that the temporary events ordinance is being updated to address the matter and coming for adoption next week.

Caller 6770 commented in regard to consent items from today's agenda Nos. C.37, C.39, C.57 and C.56  which individually aren't expensive  but together represent about $2.15 million. These items are to try the address the breakdown of society at the most fundamental levels, the individual and the family, such as victims of intimate partner violence, transitional housing for emancipated youth, domestic violence, outpatient psychiatric services to mentally ill adults. He spoke of the incredible emotional trauma of victims that affects not only them but those around them.

Oman Wilson, Antioch, spoke in favor of healthy food options being displayed near cash registers in food markets and advocated for access to sexual protection products.

Trish thanked Supervisor Mitchoff for her support of Knightsen in regard to the illegal and noisy parties and suggested increasing the amount of the fines for transgressions.

  The Board held of moment of silence in honor of the 19 children and 2 teachers killed in a mass shooting this morning at Robb Elementary School in Uvalde, Texas.

GENERAL INFORMATION
The Board meets in all its capacities pursuant to Ordinance Code Section 24-2.402, including as the Housing Authority and the Successor Agency to the Redevelopment Agency. Persons who wish to address the Board should complete the form provided for that purpose and furnish a copy of any written statement to the Clerk.

Any disclosable public records related to an open session item on a regular meeting agenda and distributed by the Clerk of the Board to a majority of the members of the Board of Supervisors less than 96 hours prior to that meeting are available for public inspection at 1025 Escobar Street, First Floor, Martinez, CA 94553, during normal business hours.

All matters listed under CONSENT ITEMS are considered by the Board to be routine and will be enacted by one motion. There will be no separate discussion of these items unless requested by a member of the Board or a member of the public prior to the time the Board votes on the motion to adopt. 

Persons who wish to speak on matters set for PUBLIC HEARINGS will be heard when the Chair calls for comments from those persons who are in support thereof or in opposition thereto. After persons have spoken, the hearing is closed and the matter is subject to discussion and action by the Board.  Comments on matters listed on the agenda or otherwise within the purview of the Board of Supervisors can be submitted to the office of the Clerk of the Board via mail: Board of Supervisors, 1025 Escobar Street, First Floor, Martinez, CA 94553
