Referral History:

At the February 2022 Public Protection Committee (PCC) meeting, the topic of Sheriff oversight was discussed as part of the update on the Racial Justice Oversight Body. The Public Protection Committee briefly discussed that the Board of Supervisor’s authority over the Sheriff’s Office has historically been exercised through its budgetary authority. The PPC directed staff to return to the PPC with additional information on the Board of Supervisor’s authority over the Sheriff’s Office.

At the April 2022 PPC meeting, the PPC discussed regular operational reporting by the Sheriff’s Office, including a discussion of Government Code section 25303 and AB 1185 (both attached). It was discussed that the proposed Sheriff reporting would aim to improve the communication and transparency between the Sheriff’s Office, the Board of Supervisors, and with the community and would allow for questions and discussion on operational issues. The parameters of the regular quarterly “Oversight Report” to the PPC was still in development and staff planned to return at the May 2022 PPC meeting with additional information. The PPC also directed staff to return with information on what other local counties are doing regarding sheriff oversight.

Referral Update:

The Sheriff’s Office will present a proposal on regular reporting to the PPC.

Regarding what counties have establish a Sheriff Oversight Board or Office of Inspector General, Sacramento, Sonoma, Santa Clara, Santa Cruz, and San Francisco, have created or established some form of Oversight Board or Office of Inspector General. Attachment C includes a summary of the actions of local counties regarding Sheriff oversight/advisory bodies.

Recommendation(s)/Next Step(s):

RECEIVE an update on regular operational reporting by the Sheriff’s Office, and on the actions of other counties to establish Sheriff oversight and PROVIDE direction to staff as needed.
