RECOMMENDATION(S):

As the governing body of the Contra Costa County Flood Control and Water Conservation District (District), APPROVE and AUTHORIZE the Chief Engineer, or designee, to execute, on behalf of the District, Amendment No. 1 to the license agreement with Precision Engineering, Inc. (Licensee), to extend the term through April 30, 2023 with a one-time administrative fee of $1,500 and a monthly fee of $1,000, for the use of a portion of District property along Bancroft Road identified as APN 147-271-010 for staging and storing of construction equipment and materials purposes, Concord, area. (Project No.: 7520-6B8366)

FISCAL IMPACT:

100% Flood Control Zone 3B Fund. The Zone 3B fund will receive a one-time administrative fee of $1,500 and $1,000 per month for 11 months..

BACKGROUND:

Contra Costa County Flood Control and Water Conservation District (District) is the owner of the real property located on Bancroft Road and identified as Assessor’s Parcel Number 147-271-010 in Concord (Property).

On May 18, 2021, the Board of Supervisors approved a license agreement between the District and Precision Engineering, Inc., (Licensee) that allowed Licensee to use a portion of the District’s property for temporary staging and storing of construction equipment and materials purposes from May 1, 2021, through April 30, 2022. Amendment No. 1 is needed to extend the term of the license agreement through April 30,2023, and requires the Licensee to pay a one-time administrative fee of $1,500 and a monthly fee of $1,000 for the term of the Agreement.

CONSEQUENCE OF NEGATIVE ACTION:

If this License is not approved, the District would not receive revenue during the term of this agreement.
