RECOMMENDATION(S):

AUTHORIZE the establishment of a separate interest-bearing account for SB 1383 Local Assistance Grant funding to comply with the grant requirements.

FISCAL IMPACT:

This recommendation will ensure the County is eligible to receive grant funding and that grant funds, along with interest earned from grant funds, will be separate from the General Fund. If approved as recommended, interest on grant funding would be segregated, allocated and expended in a manner consistent with the SB 1383 Local Assistance Grant Funding Guidelines.

BACKGROUND:

Senate Bill 1383, Short-lived Climate Pollutants Reduction, as enacted in 2017 (Lara, Chapter 395, Statutes of 2016), establishes targets to reduce the statewide disposal of organics by 50% by 2020 and 75% by 2025; and requires that not less than 20% of edible food that is currently disposed be recovered for human consumption by 2025. The state has adopted comprehensive regulations as a result of the passage of SB 1383, which impose a wide range of requirements on local jurisdictions (hereinafter referred to as the SB 1383 Regulations).

The SB 1383 Regulations require that each jurisdiction develop methods for: managing organics, procuring recycled organics, recovering edible food, regulating haulers, planning for adequate edible food and organics waste processing capacity, and conducting education/outreach, inspections and enforcement.  
  
In January 2022, the Department of Resources Recycling and Recovery (CalRecycle) announced a one-time grant program meant to aid jurisdictions in the implementation of the SB 1383 Regulations.  
  
The County has submitted an application to receive funding in the amount of $229,790, which is a population-based allocation. CalRecycle has advised that the County's specific award amount is $246,842.  
Staff is recommending the Board of Supervisors authorize the establishment of a separate interest-bearing account to segregate SB 1383 Local Assistance Grant funding and interest. This will ensure the County is eligible to receive funding and this funding, including interest, will be used for SB 1383 related programs, as required by the grant guidelines.

CONSEQUENCE OF NEGATIVE ACTION:

Establishment of a separate interest-bearing account is necessary to ensure interest is expended in the same manner as the grant funds, consistent with the grant guidelines. If a separate interest-bearing account is not created, the County would be ineligible to receive SB 1383 Local Assistance Grant funding in the amount of $246,842.
