RECOMMENDATION(S):

APPROVE and AUTHORIZE the Agricultural Commissioner, or designee, to execute an agreement with the California Department of Parks and Recreation to reimburse the County in an amount not to exceed $16,836 to control invasive artichoke thistle, for the period of May 1, 2022 through October 31, 2022.

FISCAL IMPACT:

This agreement will reimburse the County for all associated costs incurred for the work performed in the California Department of Parks and Recreation sites, Mount Diablo and Marsh Creek, in an amount not to exceed $16,836. There is no match of County funds nor grant monies involved. This revenue has been anticipated in the FY22/23 budget.

BACKGROUND:

The County’s Department of Agriculture controls invasive artichoke thistle weeds on public lands to protect natural resources and agriculture production grazing areas. Artichoke thistle has been designated a noxious weed by the Secretary of the California, Department of Food and Agriculture, Code 403. The Department performs noxious weed control to protect ranchers and sustain native plant populations, which in turn prevents soil erosion and protects wildlife diversity.


BACKGROUND: (CONT'D)
Infestations of noxious weeds constitutes a public nuisance pursuant to Food & Agriculture Code 5401. The Agriculture Commissioner can abate this nuisance pursuant to the Food and Agriculture Code 5421. Populations of artichoke thistle found on the two state park sites of Mount Diablo and Marsh Creek will be controlled according to the County Integrated Pest Management Policy. The agreement requires the County to indemnify the State for all damages and claims arising out of the performance of the Agreement.

CONSEQUENCE OF NEGATIVE ACTION:

Failure to approve this agreement will result in loss of anticipated revenue for the County and a possible threat to local agriculture.
